Introduction

Berwick Bank Wind Farm Limited (the Applicant) is seeking consent to develop the Berwick Bank Wind Farm Project. The Berwick Bank Wind Farm will be located in the outer Firth of Forth and Firth of Tay, approximately 37.8 km east of the Scottish Borders coastline (St. Abb’s Head) and 47.6 km to the East Lothian coastline. The Applicant has submitted an offshore application for consent under section 36 of the Electricity Act 1989; and marine licences under section 20 of the Marine (Scotland) Act 2010 and Section 65 of the Marine and Coastal Access Act 2009, and an onshore application for planning permission under the Town and Country Planning (Scotland) Act 1997. An Environmental Impact Assessment (EIA) has been completed for the offshore components of the Berwick Bank Wind Farm in accordance with The Electricity Works (Environmental Impact Assessment) (Scotland) Regulations 2017 (as amended), The Marine Works (Environmental Impact Assessment) Regulations 2017 (as amended) and The Marine Works (Environmental Impact Assessment) Regulations 2007 (as amended). The EIA Report (Volumes 1 to 4) has been submitted as part of the offshore consent application and is made accessible in digital format below.

A Habitats Regulations Appraisal (HRA) has also been completed as required under the Conservation (Natural Habitats, & c.) Regulations 1994, The Conservation of Habitats and Species Regulations 2017 and the Conservation of Offshore Marine Habitats and Species Regulations 2017(collectively referred to as the “Habitats Regulations”). In accordance with these Regulations a Report to Inform an Appropriate Assessment (RIAA) (Parts 1 to 3) has been completed based on the outcome from the HRA Screening (assessment of likely significant effects (LSE)).

In view of the conclusions of the offshore RIAA, it was necessary to provide the requisite information and justification (the Derogation Case) to satisfy the HRA Derogation Provisions. The documents comprising the HRA and Derogation Case are included as part of the application and also made accessible in digital format below.

An EIA has been completed for the onshore components of the Berwick Bank Wind Farm in accordance with The Town and Country Planning (Environmental Impact Assessment) (Scotland) Regulations 2017. The EIA accompanies an application to East Lothian Council (ELC) for consent under The Town and Country Planning (Scotland) Act 1997. In addition to the EIA, supporting documents including a Planning Statement (incorporating Design and Access Statement), a Pre-Application Consultation Report and planning application drawings have been submitted.

A HRA has also been completed with regards to the Conservation (Natural Habitats, & c.) Regulations 1994, Council Directive 92/43/EEC on the conservation of natural habitats and of wild fauna and flora (also known as the ‘Habitats Directive’) (as amended); Council Directive 2009/147/EC on the conservation of wild birds, codified version, (also known as the ‘Birds Directive’) (as amended). In accordance with these Regulations a RIAA has been completed based on the outcome from the HRA Screening (assessment of LSE).
